Tabber Connect – Terms and Conditions

Please read these Terms and Conditions carefully before using Tabber Connect's food delivery platform. By accessing or using our services, including our user app, restaurant app, or delivery app, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.
1. Acceptance of Terms
By creating an account, accessing, or using Tabber Connect's platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. These terms apply to all users of our platform, including customers, restaurants, and delivery personnel.
2. Description of Service
Tabber Connect is a technology platform that connects customers with restaurants and delivery personnel to facilitate food ordering and delivery services. We act as an intermediary between:
  • Customers: Users who place food orders through our platform
  • Restaurants: Food service providers who prepare and fulfill orders
  • Delivery Personnel: Independent contractors who deliver orders to customers
We do not prepare, package, or deliver food ourselves. We are not responsible for the quality, safety, or delivery of food items.
3. User Accounts and Registration
Account Creation:
  • You must be at least 18 years old to create an account
  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You may not create multiple accounts or share your account with others
Account Responsibilities:
  • You are responsible for all activities that occur under your account
  • You must keep your contact information and delivery addresses up to date
  • We reserve the right to suspend or terminate accounts that violate these terms
4. Orders and Payments
Placing Orders:
  • All orders are subject to acceptance by the restaurant
  • Restaurants reserve the right to refuse or cancel orders at their discretion
  • Order prices are set by restaurants and may vary from in-restaurant prices
  • We reserve the right to modify or cancel orders in case of errors, fraud, or unavailability
Payment Terms:
  • Payment must be made at the time of order placement unless otherwise specified
  • We accept various payment methods including credit/debit cards, digital wallets, and cash on delivery (where available)
  • All payments are processed through secure third-party payment processors
  • You agree to pay all charges associated with your orders, including food costs, delivery fees, service fees, and applicable taxes
  • Prices displayed are in the local currency and are subject to change without notice
5. Cancellation and Refund Policy
Order Cancellation:
  • Customers may cancel orders before the restaurant begins preparation
  • Once preparation has started, cancellation may not be possible or may incur charges
  • Restaurants may cancel orders due to unavailability, technical issues, or other valid reasons
  • We may cancel orders in cases of fraud, payment issues, or safety concerns
Refunds:
  • Refunds will be processed according to our refund policy and applicable laws
  • Refunds for cancelled orders will be issued to the original payment method within 5-10 business days
  • Refunds may not be available for orders that have been delivered or partially consumed
  • Disputes regarding order quality or issues should be reported within 24 hours of delivery
6. Restaurant Partner Terms
Restaurant Responsibilities:
  • Restaurants must maintain valid licenses and permits required for food service
  • Restaurants are responsible for food quality, safety, and compliance with health regulations
  • Menu items, prices, and availability must be accurately represented on the platform
  • Restaurants must prepare and package orders according to specified timelines
  • Restaurants are responsible for any food-related issues, allergies, or dietary restrictions
Commission and Payments:
  • Restaurants agree to pay applicable commission fees as per their agreement with Tabber Connect
  • Payment to restaurants will be processed according to the agreed schedule
  • Restaurants are responsible for all taxes related to their sales
7. Delivery Personnel Terms
Delivery Personnel Responsibilities:
  • Delivery personnel are independent contractors, not employees of Tabber Connect
  • Delivery personnel must have valid licenses, insurance, and vehicle registration as required by law
  • Delivery personnel must follow traffic laws and safety regulations
  • Delivery personnel are responsible for timely and safe delivery of orders
  • Delivery personnel must maintain professional conduct and customer service standards
Earnings and Payments:
  • Delivery personnel earn fees based on completed deliveries as per the agreed terms
  • Earnings will be processed according to the payment schedule
  • Delivery personnel are responsible for their own taxes and expenses
8. User Conduct and Prohibited Activities
You agree not to:
  • Use the platform for any illegal or unauthorized purpose
  • Violate any laws, regulations, or third-party rights
  • Interfere with or disrupt the platform's operation or security
  • Attempt to gain unauthorized access to any part of the platform
  • Use automated systems, bots, or scripts to access the platform
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, or harm other users, restaurants, or delivery personnel
  • Post false, misleading, or fraudulent information
  • Use the platform to transmit viruses, malware, or harmful code
  • Reverse engineer, decompile, or disassemble any part of the platform
Violation of these terms may result in immediate account suspension or termination.
9. Intellectual Property
  • All content, features, and functionality of the Tabber Connect platform are owned by us or our licensors
  • Our trademarks, logos, and brand names are our exclusive property
  • You may not use, copy, modify, or distribute our intellectual property without written permission
  • User-generated content (reviews, ratings, photos) may be used by us for platform improvement and marketing purposes
  • You retain ownership of content you submit but grant us a license to use it on our platform
10. Limitation of Liability
  • Tabber Connect acts as an intermediary platform and is not responsible for the quality, safety, or delivery of food
  • We are not liable for any food-related illnesses, allergies, or health issues
  • We do not guarantee uninterrupted, error-free, or secure operation of the platform
  • Our liability is limited to the amount you paid for the specific order in question
  • We are not responsible for delays, cancellations, or issues caused by restaurants, delivery personnel, or third parties
  • We are not liable for indirect, incidental, special, or consequential damages
  • Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you
11. Indemnification
You agree to indemnify, defend, and hold harmless Tabber Connect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
  • Your use of the platform
  • Your violation of these Terms and Conditions
  • Your violation of any law or third-party rights
  • Content you submit or transmit through the platform
12. Dispute Resolution
Customer Service:

For any disputes or issues, please contact our customer service team first. We will make reasonable efforts to resolve disputes amicably.

Governing Law:

These Terms and Conditions are governed by the laws of the jurisdiction in which Tabber Connect operates. Any disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. We will notify users of significant changes by:
  • Posting the updated terms on our website and apps
  • Sending an email notification to your registered email address
  • Displaying an in-app notification
Your continued use of the platform after changes become effective constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using the platform and may close your account.
14. Termination
  • We may suspend or terminate your account at any time for violation of these terms or for any other reason
  • You may close your account at any time through the app settings or by contacting customer support
  • Upon termination, your right to use the platform will immediately cease
  • Provisions that by their nature should survive termination will remain in effect
15. Miscellaneous
  • Entire Agreement: These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Tabber Connect
  • Severability: If any provision is found to be unenforceable, the remaining provisions will remain in full effect
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver
  • Assignment: You may not assign or transfer your account or rights without our written consent
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control
